Chapter I General Provisions
Article 1 in order to strengthen the safety supervision of special equipment, prevent and reduce accidents and protect the people
These Regulations are formulated for the safety of people's lives and property and the promotion of economic development.
Article 2 "special equipment" as mentioned in these Regulations refers to boilers, pressure vessels (including gas cylinders, the same below), pressure pipes, elevators, hoisting machinery, passenger ropeways, large amusement facilities and special motor vehicles in the field (factory) which are related to life safety and greater risk.
The catalogue of special equipment mentioned in the preceding paragraph shall be formulated by the Department in charge of safety supervision and administration of special equipment under the State Council (hereinafter referred to as the Department in charge of safety supervision and administration of special equipment under the State Council) and shall be implemented after being submitted to and approved by the State Council.
Article 3 the production (including design, manufacture, installation, transformation and maintenance, the same below), use, inspection and inspection of special equipment, as well as its supervision and inspection, shall comply with these regulations, except as otherwise provided in these regulations.
These Regulations are not applicable to the safety supervision of military equipment, nuclear facilities, aerospace vehicles, railway locomotives, marine facilities and ships, as well as special equipment used underground in mines and special equipment for civil airports.
The supervision and administration of the installation and use of hoisting machinery and special motor vehicles in the site (factory) for housing construction site and municipal engineering site shall be carried out by the construction administrative department in accordance with the provisions of relevant laws and regulations.
Article 4 the safety supervision and Administration Department of special equipment under the State Council shall be responsible for the safety supervision of special equipment throughout the country, and the departments responsible for the safety supervision and administration of special equipment at or above the county level shall be responsible for the safety supervision of special equipment within their respective administrative areas (hereinafter referred to as the safety supervision and Administration Department of special equipment).
Article 5 the production and use units of special equipment shall establish and improve the management system for safety and energy conservation of special equipment and the responsibility system for post safety and energy conservation.
The main person in charge of the production and use unit of special equipment shall be fully responsible for the safety and energy conservation of the special equipment of the unit.
Production and use units of special equipment and inspection and testing institutions of special equipment shall accept the safety supervision of special equipment conducted by the safety supervision and Administration Department of special equipment according to law.
Article 6 inspection and testing institutions for special equipment shall, in accordance with the provisions of these regulations, carry out inspection and testing work and bear legal responsibility for their inspection and testing results and appraisal conclusions.
Article 7 the local people's governments at or above the county level shall urge and support the safety supervision and administration departments of special equipment to perform their duties of safety supervision according to law, and coordinate and solve the major problems existing in the safety supervision of special equipment in a timely manner.
Article 8 the State encourages the implementation of scientific management methods, the adoption of advanced technology, the improvement of the safety performance and management level of special equipment, the enhancement of the ability of production and use units of special equipment to prevent accidents, and the awarding of units and individuals who have made remarkable achievements.
The State encourages the research, development, demonstration and popularization of energy-saving technologies for special equipment, and promotes the innovation and application of energy-saving technologies for special equipment.
Units that produce and use special equipment and inspection and testing institutions for special equipment shall ensure necessary investment in safety and energy conservation.
The State encourages the implementation of the liability insurance system for special equipment to improve the ability to pay for accidents.
Article 9 Any unit or individual shall have the right to report any act in violation of the provisions of these regulations to the safety supervision and Administration Department of special equipment, administrative supervision and other relevant departments.
The special equipment safety supervision and administration department shall establish a special equipment safety supervision and reporting system, announce the reporting telephone number, mailbox or e-mail address, accept the reporting of illegal activities in the production, use, inspection and detection of special equipment, and deal with them in a timely manner.
The safety supervision and Administration Department of special equipment, the administrative supervision department and other relevant departments shall keep secrets for the informant and give rewards in accordance with the relevant provisions of the state.
Chapter II production of special equipment
Article 10 production units of special equipment shall carry out production activities in accordance with the provisions of these regulations and the requirements of the safety technical specifications (hereinafter referred to as the safety technical specifications) formulated and promulgated by the special equipment safety supervision and administration department under the State Council.
The production unit of special equipment shall be responsible for the safety performance and energy efficiency index of the special equipment it produces, and shall not produce special equipment that does not meet the safety performance requirements and energy efficiency index, or special equipment that is explicitly eliminated by the state industrial policy.
Article 11 the designer of a pressure vessel shall obtain the permission of the special equipment safety supervision and administration department under the State Council before engaging in the design activities of the pressure vessel.
The design unit of pressure vessel shall meet the following conditions:
(1) Have design personnel and design reviewers suitable for pressure vessel design;
(2) There are places and equipment suitable for pressure vessel design;
(3) Have a sound management system and responsibility system suitable for pressure vessel design.
Article 12 the design documents of gas cylinders (hereinafter referred to as gas cylinders), oxygen tanks, passenger cableways, large amusement facilities and high energy consumption special equipment in boilers and pressure vessels shall be appraised by the inspection and testing institution approved by the special equipment safety supervision and administration department under the State Council before they can be used for manufacturing.
Article 13 in accordance with the requirements of safety technical specifications, type tests and energy efficiency tests must be carried out for special equipment products and components that shall undergo type tests or for trial production of new products, new components and new materials for special equipment.
